SC postpones deliberation and voting on DAP case

MANILA, Dec. 3 — The Supreme Court during an en banc session Tuesday decided not to pursue with the scheduled deliberations and voting on the DAP case.

This was after Chief Justice Maria Lourdes P. Aranal-Sereno went to Malacanang as guest speaker for the United Nations Convention Against Corruption program.

At the same time, Associate Justice Arturo D. Brion asked for the postponement to have more time to study the DAP case.

The case is rescheduled to be tackled by the high court on its next agenda on Jan. 13, 2015.

The SC will have its last en banc session on Dec. 9, 2014.

The DAP was declared unconstitutional by the SC last July when the justices voted unanimously in declaring Department of Budget and Management Circular 541, giving life to DAP, as illegal and unconstitutional.

This prompted Malacanang to file its motion for reconsideration, praying for the reversal of the 13-0 SC decision.

There are 12 justices who concurred in the result of the ponencia of Associate Justice Bersamin for making DAP illegal.

Meanwhile, there are nine petitions against DAP which was led by the Integrated Bar of the Philippines (IBP), Philippine Constitutional Association (Philconsa), Volunteers Aganst Crime and Corruption (VACC), Carol Araullo, Pork Barrel System petitioners led by Greco Belgica, Reuben Abante, Jose Gonzales; former Iloilo Rep. Augusto Syjuco, Citizens Crime Watch represented by Atty. Jose Malvar Villegas, Jr. and Atty. Manuelito R. Luna. (from PNA report by Perfecto T. Raymundo )
